Undocumented and Injured? You May Have Rights to Compensation

Undocumented individuals living in Florida and Georgia may not be aware that they do have certain rights. They have the right to be treated fairly and this includes compensation for personal injuries. Whether it is an auto accident, housing or fraud, don’t be a victim. Many laws prohibit discrimination, often including national origin and race.

Knowing your rights is half the battle

If you have been seriously injured a personal injury law firm may be able to help you. Your rights include:

  • Auto accidents: When another driver causes an injury, speak up. You may have the right to compensation.  Based on the circumstances of your accident, recovery may include medical costs and other expenses. Whether another vehicle caused the accident and you were the driver, a passenger or a pedestrian, your legal status should not affect these rights.

  • Slip and fall injuries:  Whether you fell on a slippery floor, poorly lit hallway or were hit by something that fell from a shelf in a store— if you have been injured you have rights to fight for recovery.

  • Fraud: When filing for a change of status for yourself or a family member, don’t be a victim of fraud. If someone has willingly deceived you or a family member, you can seek damages.

  • Workers’ compensation: Florida expressly covers workers’ compensation for undocumented workers. If you have been injured on the job, don’t let your immigration status hinder you from seeking justice.

  • Medical malpractice: A doctor’s misdiagnosis, a medical error or pharmaceutical errors could result in disastrous results.

Things to keep in mind

Being in the U.S. without proper immigrations status is, of course, illegal and you could face immigration-related charges or deportation. However, this is separate from your rights to sue for damages. The person or company that is responsible for your injury may not be aware of your status. Citizenship is not a requirement for access to justice.
